Refund policy

At Lekka Home, we want you to be happy with your purchase. If something isn’t right with your order or your PopMop, please contact us at lekkahomeza@gmail.com and we’ll work with you to resolve the issue.

This policy is intended to comply with applicable South African consumer-protection legislation, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Nothing in this policy limits or excludes any rights you may have under applicable South African law.

1. Cooling-off period for online purchases

For qualifying electronic transactions, you have the right under ECTA to cancel your purchase without giving a reason and without penalty within seven days after receiving the goods.

If you exercise this right, you are responsible only for the direct cost of returning the goods to us.

Once the cancellation is validly exercised and the goods have been returned, we will process the applicable refund in accordance with ECTA. Where payment has already been made, ECTA provides for the refund to be made within 30 days of cancellation. 

This cooling-off right is separate from any additional voluntary return policy offered by Lekker Home and does not affect your other statutory consumer rights.

2. Defective, unsafe or poor-quality products

Your PopMop and its components are covered by the implied warranty of quality provided for under section 56 of the CPA.

If, within six months of delivery, the product fails to meet the applicable requirements of section 55 of the CPA because it is defective, unsafe, not of good quality, not in good working order, or otherwise unsuitable for its reasonably intended purpose, you may return the product without penalty and at our risk and expense, subject to the requirements of the Act. 

Where section 56 applies, the consumer may direct the supplier to:

  • repair the product;
  • replace the product; or
  • refund the price paid for the product.

We will not attempt to replace these statutory remedies with store credit or another remedy where the law gives you a different right. 

If a repaired product experiences the same or another qualifying defect within three months following the repair, the CPA provides for replacement or refund in the circumstances specified by the Act. 

3. Incorrect, incomplete or misrepresented orders

If you receive:

  • the wrong PopMop pack;
  • fewer items than you ordered;
  • a product materially different from its description; or
  • an order containing incorrect or missing components,

please contact us at lekkahomeza@gmail.com as soon as reasonably possible.

We will investigate the issue and provide the appropriate remedy in accordance with your rights under applicable consumer law.

Where we have supplied the incorrect product or failed to supply what was agreed, we will arrange the appropriate return and remedy at our expense where required by law.

4. Goods that do not meet their intended purpose

The CPA provides additional return rights in certain circumstances where goods were supplied for a particular purpose communicated to the supplier and are found to be unsuitable for that purpose within the applicable period.

Where such a statutory right applies, we will honor it in accordance with the CPA. 

5. Change-of-mind returns

In addition to your statutory rights, Lekka Home offers the following voluntary change-of-mind return option:

You may request a change-of-mind return within 14 days of receiving your order, provided the product is unused, undamaged and returned with all original components and packaging.

For hygiene and product-quality reasons, we may not accept a voluntary change-of-mind return where the PopMop or replacement heads have been used, washed or otherwise put into service, except where a statutory right to return applies.

For voluntary change-of-mind returns:

  • the customer is responsible for the direct cost of returning the product;
  • the product must be safely packaged;
  • all components supplied with the product must be returned; and
  • the product must be in a condition suitable for resale.

This voluntary policy does not limit or replace any statutory right you may have under the CPA, ECTA or any other applicable law.

6. Products damaged through misuse

A product will not ordinarily be considered defective merely because it has been damaged through misuse, abuse, unauthorized modification, improper storage, failure to follow supplied instructions, or use outside its reasonably intended purpose.

This does not exclude any rights that cannot lawfully be excluded under South African consumer law.

7. Normal wear and tear

Normal wear and tear resulting from reasonable and ordinary use is not necessarily a manufacturing defect.

Where a product failure occurs, we will assess the circumstances fairly and in accordance with the applicable consumer-protection legislation.

8. How to request a return

Please include:

  • Your full name
  • Order number
  • Date of purchase
  • Product purchased
  • Reason for the return
  • Description of the problem, where applicable
  • Photographs or video showing the issue, where reasonably possible

Photographs or videos can help us identify and resolve problems quickly, but we will not use a request for photographs or video to unlawfully prevent you from exercising a statutory right to return goods.

We will respond with the applicable return instructions.

Please do not send products back without first contacting us, as this may delay the processing of your return.

9. Return shipping

Where a return is required because the goods are defective, unsafe, incorrectly supplied, or another statutory right applies, Lekka Home will bear the applicable return costs as required by law.

For voluntary change-of-mind returns, the customer is responsible for the direct cost of returning the goods.

10. Refunds

Once a return has been received and assessed, we will process the applicable refund in accordance with the reason for the return and the requirements of applicable law.

Where reasonably possible, refunds will be made using the original payment method.

The time it takes for a refund to appear in your account may depend on your bank, card issuer or payment provider.

Where legislation prescribes a specific refund period, that statutory period will apply.

11. Sale items and promotional purchases

Purchasing a product on sale, during a promotion or as part of a discounted bundle does not remove or reduce any statutory consumer rights.

Where a statutory return or refund right applies, it will be dealt with in accordance with applicable law.

12. Our commitment

We reserve the right to assess returns to determine the nature and cause of a reported problem and to apply the appropriate remedy.

However, nothing in this policy is intended to exclude, restrict or waive any right or remedy that cannot legally be excluded under South African law.
